Terms and Conditions for Short-Term Holiday Rental

Welcome to our Oasis; two-bedroom holiday apartment in Denia, Spain. By booking your stay, you agree to the following terms and conditions. Please read carefully.
1. Booking and Reservation
1.1 Booking Confirmation: All bookings are subject to confirmation. A booking is considered confirmed once the guest receives a confirmation email with booking details.
1.2 Payment: Full payment must be received at least 7 days prior to check-in, unless otherwise agreed. Payments are accepted via bank transfer or through our online payment system.
1.3 Security Deposit: A security deposit of €250 is required for each booking. The deposit will be refunded within 7 days of check-out, provided there are no damages or violations of the house rules.
1.4 Cleaning Fee: A cleaning fee of 70euros in paid for each booking and includes coverage of one thorough clean of the property and the changing of bedding and kitchen and bathroom towels. An additional cleaning can be requested by the guest with an advanced notice of 3 days for an additional 50euros, but they must make the property available to the cleaners during the scheduled time.
2. Check-In/Check-Out
2.1 Check-In Time: Check-in is available from 15:00pm on the day of arrival.
2.2 Check-Out Time: Check-out must occur by 10:00am on the day of departure.
2.3 Late Check-Out: Requests for late check-out will be considered based on availability and may incur additional charges.
2.4 Early Check-In: Requests for early check-in must be made in advance and are subject to availability.
3. Rental Period and Occupancy
3.1 Minimum Stay: The minimum stay is 3 nights.
3.2 Maximum Occupancy: The apartment can accommodate up to 4 persons (including children).
3.3 Guests: The person making the booking must be at least 18 years old and will be responsible for ensuring that all guests comply with these terms and conditions.
4. Cancellation and Refund Policy
4.1 Cancellation by Guest: Cancellations made 10 days or more before the check-in date will receive a full refund. Cancellations made less than 10 days before the check-in date will incur a 75% cancellation fee.
4.2 Cancellation by Host: If for any reason the host is unable to honor the reservation, a full refund will be issued to the guest, and the host will not be liable for any additional costs incurred by the guest.
5. House Rules
5.1 Noise: Please be respectful of neighbors. Quiet hours are from [23:00 PM] to [8:00 AM].
5.2 Smoking: Smoking is not allowed inside the apartment. Smoking is only permitted in designated outdoor areas.
5.3 Pets: Pets are not allowed unless explicitly stated in the booking confirmation.
5.4 Parties and Events: Parties or events are not permitted in the apartment without prior approval from the host.
5.5 Damage and Loss: Guests are responsible for any damage or loss caused to the property during their stay. Any damage must be reported immediately.
5.6 Furniture and Equipment: Please do not move the furniture or any equipment in the apartment without prior consent.
5.7 Security: Guests are responsible for locking all doors and windows when leaving the apartment. The host is not responsible for any loss of personal belongings.
6. Maintenance and Repairs
6.1 Repairs: The host will make reasonable efforts to ensure the apartment is in good condition. In the case of any urgent maintenance issues, the guest should contact the host immediately.
6.2 Failure of Equipment: The host is not responsible for the failure of non-essential equipment or appliances (e.g., Wi-Fi, TV, etc.) during the stay. Efforts will be made to repair or replace faulty items as soon as possible.
7. Liability
7.1 Guest Responsibility: Guests are responsible for their own safety and the safety of their children and visitors while on the property.
7.2 Host Liability: The host is not liable for any injury, loss, or damage to the guest, their property, or any third parties during their stay, except in cases of gross negligence by the host.
8. Local Laws and Regulations
8.1 Compliance with Laws: Guests agree to comply with all local laws and regulations during their stay, including noise ordinances, waste disposal rules, and parking regulations.
8.2 Tourist Tax: Guests are required to pay a local tourist tax, if applicable, which will be collected upon check-in. The tourist tax is included in the amount paid at booking.
9. Privacy and Data Protection
9.1 Personal Information: The host may collect personal data necessary for booking and managing the rental, in compliance with Spain’s data protection laws.
9.2 Privacy: The host will not share personal information with third parties, except as required by law or for booking management purposes.
10. Governing Law and Dispute Resolution
10.1 Governing Law: These terms and conditions are governed by Spanish law.
10.2 Dispute Resolution: Any disputes arising from the rental agreement will be resolved in the competent courts of Denia, Spain.
11. Miscellaneous
11.1 Force Majeure: Neither party will be held liable for failure to fulfill obligations due to events outside of their control, including but not limited to natural disasters, government restrictions, or pandemics.
11.2 Amendments: The host reserves the right to amend these terms and conditions at any time. Guests will be notified of any significant changes prior to their arrival.
